Since when has that stopped the ACLU?  Most of the 10 commandments
displays being removed were paid for by private funds.  Their
vendetta is not based on law - even on their innovative Separation
of Church and State consitutional "amendment".  (Yes - I know it is
not in the constitution - but most people and even courts seem to
think it is due to relentlessly marketing since its invention in 1890.)
