FYI - I thought ya'll might be interested in an important pro-life activity in South Carolina.  This would be a good law for all the states to pass.

Subject:  S.C. Senate passes Autumn's Law

 

SC Senate Passes Autumn's Law

 

A state law to terminate a rapist’s ability to claim “parental rights” to a child conceived in rape unanimously passed the SC Senate Thursday (March 31, 2005) on second reading. 

 

The bipartisan legislation is co-sponsored by Sen. Phil Levintis, D-Sumter, Sen. Mike Fair, R-Greenville, and Sen. Chip Campsen, R-Charleston. 

 

South Carolina Citizens for Life strongly supports the Senate bill and the companion bill in the S.C. House.  We call the legislation "Autumn’s Law" for a child named Autumn who was conceived when her 13-year-old mother was violently raped and heroically chose to give Autumn the gift of life. 

 

When Autumn's grandparents, Jimmy and Ginger Foisey of Sumter, began adoption proceedings the rapist threatened to claim "parental rights" to Autumn.  He attempted to coerce the Foiseys to drop the criminal sexual conduct charges in exchange for his giving up claims to parental rights. 

 

The Foisey's refused and were shocked to learn that the man who violently raped their 13-year-old daughter was not barred by law from claiming parental rights to Autumn. As a result, Rep. Bob Leach, R-Greenville, intoduced Autumn's Law into the House, and Senators Leventis, Fair, and Campsen introduced it in the SC Senate.

 

SCCL lobbyist Lisa Harris praised the Senate for its unanimous support of Autumn's Law.  "If rape victims are not protected from this kind of abuse from criminal attackers," she said, "then we have a system whereby the only way to assure that the victim is protected is to abort the child."  

 

"Aborting a child conceived in rape is punishing the innocent unborn baby instead of punishing the criminal rapist," said Holly Gatling, SCCL's executive director. "Victims of crime should never be forced to have a relationship with the criminal who assaulted them. Autumn's Law provides protection for both the mother and unborn child from further abuse and trauma by a violent sexual predator." 

 





Autumn's Law is now before the full SC House Judiciary Committee.  It passed the General Laws subcommittee unanimously on Tuesday, March 29, 2005.  Members of the bi-partisan General Laws subcommittee are Representatives John Graham Altman, R-Charleston, James Smith, D-Richland, John Scott, D-Richaland, Rubin T. Rivers Jr., D-Jasper, and Gloria Haskins, R-Greenville.
